This Acceptable Use Policy ("AUP") governs the use of all products and services provided by HostInstance ("HostInstance", "we", "our", or "us"), including but not limited to shared hosting, reseller hosting, VPS hosting, cloud hosting, dedicated servers, and any other services offered by HostInstance.
By using any HostInstance service, you agree to comply with this AUP, our Terms of Service, and all applicable laws and regulations. Violation of this AUP may result in suspension, restriction, or termination of services without refund.
HostInstance's primary purpose is to provide reliable, high-performance hosting and internet infrastructure services. To ensure a safe and stable environment for all customers, all users must use our services responsibly and in accordance with this AUP.
You are responsible for all activities conducted through your account, whether performed by you, your employees, contractors, customers, visitors, or any other third party.
If the security of your account or server is compromised, you remain responsible for all resulting activities, including but not limited to:
You are responsible for maintaining the security of your account credentials and server environment at all times.
Customers must take reasonable precautions to secure their systems, including:
HostInstance is not liable for customer content or security breaches caused by customer negligence.
Any charges, fees, mitigation costs, blacklisting fees, or recovery costs resulting from inadequate security remain the responsibility of the customer.
Customers may access and utilize HostInstance's public and private networks only for lawful purposes.
The following activities are strictly prohibited:
HostInstance reserves the right to suspend or terminate services that negatively impact network stability or other customers.
You may not engage in illegal, abusive, irresponsible, or harmful behavior, including but not limited to:
You may not publish, transmit, distribute, store, or make available content that HostInstance reasonably determines:

The display, distribution, transmission, or storage of pornography, sexually explicit content, acts of copulation, or exposed genitalia is prohibited unless expressly permitted under the applicable hosting plan and local laws.

Content that is malicious, deceptive, fraudulent, or likely to result in complaints, legal liability, or harm to HostInstance's reputation. HostInstance has zero tolerance against such activities. Your service will be terminated immediately without any intimation.
Customers may not publish, distribute, or reproduce copyrighted works unless:
HostInstance reserves the right to remove infringing content and terminate repeat copyright offenders.

If any customer, reseller, or end-user causes:

Operating services for entities listed on recognized anti-spam or abuse databases may constitute a violation of this AUP.
To ensure service stability, customers may not:

d) Run unattended background processes or daemons.
e) Operate software that interfaces with IRC networks.

g) Operate gaming servers.
HostInstance reserves the right to suspend services consuming excessive resources.
Shared and Reseller Hosting
The following are prohibited:
VPS and Dedicated Servers
IRC and P2P applications may be permitted provided:
HostInstance may filter, suspend, null-route, or terminate services that cause network disruption.
Operation of IRC servers connected to public/global IRC networks may be restricted at HostInstance's discretion.
Customers may use the storage allocated to their hosting plan.
HostInstance may investigate unusually rapid growth, excessive file storage, or storage usage inconsistent with normal website hosting purposes.
Storage may not be used primarily for:
Bandwidth allocations are determined by the hosting package purchased.
If a customer exceeds their allocation, HostInstance may:
Unused bandwidth does not carry over between billing periods.
Features advertised as "Unlimited" remain subject to:
Unlimited features are not intended for abusive, excessive, or enterprise-scale usage inconsistent with the hosting plan.
All IP addresses assigned by HostInstance remain the exclusive property of HostInstance.

HostInstance reserves the right to reclaim IP addresses at any time.
HostInstance may provide private networking facilities for:
Use of private networking must remain lawful and consistent with this AUP.
Customers must maintain accurate and current registration information for all hosted domains.
Failure to maintain valid WHOIS or registrar information may result in service suspension.

Mass posting, spam, off-topic advertising, and abusive conduct are prohibited.
HostInstance does not actively monitor customer content.
However, HostInstance reserves the right to investigate complaints, abuse reports, legal notices, or suspected violations.
Upon investigation, HostInstance may:

HostInstance may disclose customer information when required by:

HostInstance disclaims responsibility for customer actions, hosted content, or misuse of services.
HostInstance may suspend, restrict, or terminate any service immediately, with or without notice, if:
